These Terms and Conditions govern access to AlphaAuto, a vehicle-listing marketplace and related account, listing, offer and support tools operated from Romania.
1. Service Provider, Legal Information and Scope
These Terms apply whenever you browse AlphaAuto, create an account, publish or manage a listing, save vehicles, send offers, use credits, or contact us through the platform.
AlphaAuto is an intermediary information-society service for vehicle listings. Unless we expressly state otherwise for a separate service, AlphaAuto is not the seller, buyer, reseller, dealer, inspection provider, escrow service, insurer, finance broker or payment processor for vehicles listed by users.

- The platform is provided electronically and the operator details shown below are made available so users, authorities and business partners can contact us directly and effectively.
- Listings, offers and messages are user-generated or user-directed. We provide the technical environment, but users remain responsible for the information and commitments they provide.
- If you use AlphaAuto in a business or professional capacity, you remain responsible for your own trader disclosures, tax obligations, consumer information duties, authorisations, warranties and legal compliance.
2. Eligibility, Accounts and Sign-In
You may use the platform only if you have legal capacity to enter into binding arrangements under applicable law.
- You should be at least 18 years old, or otherwise legally capable of using the service under the law that applies to you.
- Account information must be accurate, current and not misleading, including your name, email address, phone number, role and any contact details you choose to publish.
- You must keep control of your email inbox and any registered passkeys or authentication methods used to access your account.
- You are responsible for activity carried out through your account until you notify us of unauthorized access or a security issue.
3. Platform Functions, Ranking and Promotions
AlphaAuto provides tools that let users discover vehicles and manage listing visibility within the platform.
- Create, edit, activate and promote listings through the internal credit system.
- Search, filter, save favorites, compare vehicles and view seller profiles.
- Send or receive expressions of interest and manage seller-buyer contact flows.
- Contact the platform team regarding listings, credits, reports or support matters.
- Search and listing order may depend on relevance, filters selected by the user, listing freshness, availability, location, price and whether a listing has been promoted through credits or another clearly identified promotional feature.
4. Traders, Private Sellers and Consumer Information
AlphaAuto may display listings from private individuals and from users acting in a business or professional capacity. The legal status of the seller matters for consumer rights and must not be misrepresented.
- Sellers must select and maintain the correct account or seller type. A trader, dealership or professional seller must not present itself as a private seller.
- Professional sellers are responsible for providing all mandatory information required by Romanian and EU consumer law, including identity, contact details, pricing, taxes, warranties, conformity rights and any applicable commercial guarantees.
- If a user lists a vehicle on behalf of another person or company, that user must have authority to do so and must make the relationship clear where needed.
- A transaction with a genuine private seller may not grant the same statutory consumer rights as a transaction with a trader. Buyers should verify seller status before concluding a sale.
5. Listing Rules and User Content
When you publish a listing, you remain solely responsible for the legality, accuracy and completeness of the listing and of any text, images or statements you upload.
- Only advertise vehicles that you own or are authorized to sell or promote.
- Describe the vehicle honestly, including price, mileage, condition, ownership status, accident history known to you, major defects, financing or leasing restrictions and other information that could materially affect a buyer's decision.
- Only upload content you own or are entitled to use, and do not infringe intellectual-property, privacy, personal-data or image rights.
- Keep the listing status current and promptly mark a vehicle as unavailable, sold or withdrawn when that becomes true.
- Any price, tax status, negotiability, financing note or included service must be clear and not misleading. Professional sellers are responsible for showing consumer-facing prices in the legally required manner.
- Do not publish unlawful, misleading, discriminatory, offensive, infringing, unsafe, counterfeit, manipulated or fraudulent content.
6. Offers, Inspections and Transactions Between Users
AlphaAuto may provide tools that help buyers and sellers express interest or start a conversation. Unless the platform expressly states otherwise, an offer sent through AlphaAuto is an invitation to negotiate and does not by itself create a binding sale contract.
- The sale contract, payment, delivery, transfer paperwork, taxes, registration steps, inspection and financing arrangements are handled directly between the parties.
- Users must perform their own checks regarding identity, ownership, service history, liens, taxes, mileage, technical condition and required transfer documents before concluding a transaction.
- For Romanian vehicle transfers, parties should verify the documents required by law and by the competent authorities, including identity documents, registration documents, fiscal documentation, insurance and any contract or invoice applicable to the transaction.
- Disputes related to vehicle condition, title, hidden defects, price or performance of the sale remain between the contracting parties, although we may preserve records or cooperate with lawful requests.
7. Credits and Optional Paid Services
Credits are an internal platform utility used to unlock listing creation, visibility extensions and promoted placement.
- Credits may be purchased through the in-app Stripe checkout when enabled, and may also be assigned manually by the AlphaAuto team or platform administrators when appropriate.
- Credits are not money, e-money, a deposit or a bank account balance, and they cannot be redeemed for cash unless mandatory law requires otherwise.
- We may correct obvious grant errors and reverse credits obtained through abuse, fraud, chargeback or technical malfunction.
- Before a paid credit purchase is completed, the checkout flow shows the applicable price, taxes where available, and payment provider. Any withdrawal, refund, chargeback, or invoicing rights required by law apply according to the checkout terms and applicable law.
8. Prohibited Conduct and Safety
Users must use AlphaAuto in good faith and in a way that does not harm other users, the platform or lawful public interests.
- Do not use fake identities, stolen images, false vehicle data, manipulated documents, phishing links, advance-fee scams or other fraudulent practices.
- Do not evade account limits, moderation measures, security checks, reporting tools or future payment or billing controls.
- Do not scrape, crawl, copy, extract or reuse platform data at scale without our prior written permission, except where mandatory law permits it.
- If you see suspected fraud, illegal content, unsafe listings or misuse, report it through the contact form or legal contact address.
9. Moderation and Enforcement
We may take proportionate measures to protect the platform, users and legal compliance.
- Refuse, suspend, edit, de-rank or remove listings or accounts that appear unlawful or contrary to these Terms.
- Request clarifications or supporting information where we reasonably need to verify a listing or investigate abuse.
- Where required, we will provide a clear explanation of significant moderation measures affecting user content or accounts.
- Users may contest moderation decisions by contacting us with the relevant account, listing URL, reasons for the challenge and supporting information.
- Limit access, suspend features or terminate accounts in cases of repeated infringement, spam, impersonation, fraud, manifestly unfounded notices or security risk.
- Retain or disclose information when required by law or by a valid request from competent authorities.
10. Illegal-Content Notices and DSA Contact Point
For platform communications, legal notices, authority requests and reports about allegedly illegal content, we operate the electronic point of contact shown below.
- A notice should include the exact URL or information needed to locate the content, the reasons why you believe it is illegal, your name and email address, and a good-faith statement that the information is accurate and complete.
- We review notices in a timely, diligent, non-arbitrary and objective manner, taking account of the information available to us and the rights and legitimate interests involved.
- We may take proportionate action against users or notice submitters who repeatedly provide manifestly illegal content or repeatedly submit manifestly unfounded notices.
- At this time, moderation decisions affecting listings and accounts are reviewed by people and are not made solely by automated means.
11. Intellectual Property and Licence
The software, branding, design, database structure and other platform content belonging to AlphaAuto remain our property or the property of our licensors. By uploading listing content, you grant us a non-exclusive, worldwide licence, for the time needed to operate, secure, display, index, moderate and promote the service, to host, store, reproduce, technically adapt, display and distribute that content within the platform and related promotional materials for the listing.
12. Liability
We use reasonable care in operating AlphaAuto, but we do not guarantee uninterrupted availability or that every listing or user statement is complete, accurate or current.
- We are not a party to vehicle sale contracts concluded between users and we do not guarantee the quality, safety, legality, conformity or ownership status of listed vehicles.
- Temporary downtime, maintenance, security interventions or third-party provider failures may affect access to the service.
- Nothing in these Terms excludes liability that cannot be excluded under applicable law, including for willful misconduct, gross negligence or mandatory consumer rights.
13. Account Closure, Suspension and Effects
Users may stop using the platform at any time and may request account deletion through the available account tools or by contacting us.
- Deletion or closure may remove profile data, active listings, saved items, offers, passkeys and sessions, subject to technical backup cycles and mandatory retention needs.
- We may suspend or close accounts where necessary for security, legal compliance, repeated breach, non-payment of future billable services, fraud or serious misuse.
- Terms that by their nature should continue after account closure, including liability limits, intellectual-property licences needed for past operation, dispute records and legal retention clauses, remain effective.
14. Changes, Governing Law and Complaints
We may update these Terms when the service, legal requirements or risk profile changes. Material updates will be posted on the platform and, where appropriate, notified through the service or by email.
- The updated version applies from the date shown on this page. Continued use after that date means you accept the revised Terms.
- These Terms are governed by Romanian law, without prejudice to any mandatory consumer-protection rules that may apply under EU law.
- If you are a consumer, nothing in these Terms limits mandatory rights you may have against a trader or service provider under Romanian or EU consumer law.
- For platform complaints, contact us first so we can try to resolve the issue quickly. Data-protection complaints may also be submitted to the Romanian supervisory authority (ANSPDCP). Consumer-protection complaints relating to our own services may be addressed to the competent consumer authority where applicable. Other disputes may be brought before the competent courts according to applicable law.
15. Consumer Complaints and Alternative Dispute Resolution
If you are a consumer and a dispute concerns AlphaAuto's own paid services, contact us first so we can review the issue. Vehicle-sale disputes usually remain between the buyer and the seller because AlphaAuto is not the vehicle seller.

- The former EU Online Dispute Resolution platform was discontinued by the European Commission; do not rely on old ODR links for new complaints.
